Q |
Then you went up there, did you? |
A |
Yes, sir, as fast as we could go. |
Q |
Go up on a kind of a run did you? |
A |
Just as fast as we could run. |
Q |
When you got there was there anybody there besides Mrs. Golden? |
A |
No, sir. |
Q |
Did she say anything to you when you got there? |
A |
Yes, she turned around and she said and who are you. |
Q |
And what else? |
A |
That is all she said then. Tom ran up and showed her who we were, we run up and showed her who we were. |
Q |
Did she say anything about you? |
A |
She said she thought we come back to kill her. |
Q |
And she said she thought you were the ones that killed Mart too, didn’t she? |
A |
She didn’t say any such a thing. |
Q |
Did she say anything like that? |
A |
No, sir. She said she didn’t know but what the ones that had killed Mart had come back to kill her. |
Q |
Did she make that remark more than once? |
A |
I don’t know whether she did or not, I never heard her. |
Q |
I suppose she was pretty excited? |
A |
Yes, sir. She possibly might have told other people about it. |
Q |
And then after she found out who you were everything was all right? |
A |
Yes, sir. |
Q |
Did she make that remark to you, to ether you or Tom after she |
Page 125 |
Q |
found out who you were? |
A |
She made the remark on the instant before she recognized us. |
Q |
And did she make any remark of that kind after she found out who you were? |
A |
Not to us she didn’t. |
Q |
Did she to any one else? |
A |
She possibly might have told them that she thought we were the ones that killed Martin and we come back to kill her. I don’t know as to that. |
Q |
How long id you stay there before you helped carry Martin into the house? |
A |
We picked him up and carried him in just as soon as we run up there and Minnie said, “pick him up and carry him into the house”. We might possibly have been there a few seconds. |
Q |
Was there anybody else there besides Mrs. Golden and you and your cousin? |
A |
Not when we carried him into the house. |
Q |
About how far was it you had to carry him? |
A |
Well probably thirty or forty feet. |
Q |
And who came first after you got him into the house if you remember? |
A |
I think Mr. Carr, Alex Carr. |
Q |
And then Mrs. Carr? |
A |
No, I think the hired girl came back, I think she had gone after Mrs. Carr. |
Q |
Did you make an examination of the wounds in his head? |
A |
I looked at them from the outside, I didn’t make any further examination. |
Page 126 |
Q |
What did they look like? |
A |
They looked as though there had something gone in there. |
Q |
What was it, describe it. |
A |
It was bulging out when we got to the ground, the brains were ozzing out of his forehead and some blood. |
Q |
About how large a hole was there if any? |
A |
I couldn’t say as to that. |
Q |
Did it look about the size of a lead pencil or was there any hole or was it closed up or were the brains ozzing out? |
A |
Yes, sir, the brains and blood had ozzed out, and the brains and blood were larger than the hole really was so I couldn’t say as to what the size of the hole really was. |
Q |
Were there any marks on him of powder, powder marks on his face? |
A |
I think there was a few right around on his forehead. |
Q |
And did it blacken up his forehead considerable? |
A |
Well some there was a few powder marks on his forehead. I don’t remember, the crowd was so large, everybody wanted to look at him. |
Q |
How long did you stay there that night? |
A |
I stayed until about three o’clock in the morning. |
Q |
Did you and Tom go home together? |
A |
No, sir. |
Q |
Was Tom there when you left? |
A |
Well I don’t remember. Tom went up home and got his wife and they came back and I don’t remember when they left. I was there until three o’clock in the morning, over there at the house part of the time and over at the store part of the time. |
Q |

A |

A |

Q |
Yes, and Joe wanted to know all about it didn’t he? |
A |
Yes, sir, he told me he didn’t want no explanations, he said he didn’t care for an explanation from me he was satisfied. |
Q |
What did you tell him? |
A |
I didn’t tell him anything I don’t think only what I have told here. |
Q |
Did you tell him what you have told here? |
A |
I told it all and I have told it so many times - - |
Q |
(Interrupting) Did you tell Mr. Shea? |
A |
I didn’t talk very much to Mr. Shea, he didn’t seem to have much to say |

Q |

Q |
And did you testify before the coroner as you have testified here? |
A |
Oh possibly not all, I just answered the questions in front of the coroner as they were asked. |
Q |
And have you talked this matter over a good many times with Tom since then? |
A |
This matter I don’t believe has been mentioned between Tom and I since until the case came up again. |
Q |
Did you have any knowledge at the time you told the deputy Sheriff about it of who this was that ran by you? |
A |
