Did you talk with either one of them?

A

I have since.

You did not at the time?

A

No, not at that day.

Was Griswold at the saloon when you left?

A

Why just as soon as we had our drink I went right out and went back to the office.

Did you see this man Green in the saloon, Frank Green?

A

I don’t remember of seeing Mr. Green there.

You don’t remember of his being there?

A

I don’t remember seeing him at that time, he might have been back in to the card table somewhere there.

What were you doing on the forenoon of that day?

A

Tending to the post office.

On the day following that you attended the post office just the same.

A

No, sir, I was called to look up this case of the murder.

And then you went to Denison?

A

Yes, sir.

When did you first learn of the murder?

A

Why it was about, somewheres about I think ten o’clock that night.

But you didn’t go to Denison until the next morning?

A

No, the car had gone east and I didn’t go.  I think it was after ten.

How far is Nunica from Denison?

A

Why about three miles or a little over.

Did you see Shimmel or the Frenchman after you seen them in the saloon that day?

A

Do you mean the day I was in the saloon?

The day of the 23rd, yes sir.

A

No, sir, I didn’t see him afterwards not that I know of.

Did you see him before that?

A

I think I did see him coming up the street from the other saloon, from Haas saloon, right after dinner or just before dinner.

That was Shimmel?

A

I think they both was together.

 

 

Q

You had seen Shimmel before this you say?

A

Well I would not have known him at all.

 

 

Q

That was quite a number of years before?

A

That was quite a while ago.

Were you in the other saloon that day?

A

No, sir.

 

 

Q

What was that day, a warm day or cold?

A

Why they were at work anyway dragging in oats and things like that.  The next day I was down the track looking up this matter and a fellow just east of town said that he saw Shimmel go by when he was dragging in oats that same day.
