Well that was the conversation of both of them about - - was the car.

Now have you detailed to me all those people that were in there that day?

A

All that I can recall now.

Now we will say that this was three o’clock as you claim, about three o’clock - - it must have been before that if he wanted to catch the three o’clock car, wasn’t it?

A

The cars did not run exactly on the hour.

 

 

Q

What time does that car go through Nunica, the three o’clock that you refer to?

A

It is either 3:19 or 3:29, I won’t be sure which.  They were on the hour and a half schedule then.

You say when he came into your place he said he had just got off from the other car, hadn’t he?

A

Why I didn’t say that.

What did you say?

A

I said that he either said he come in on the other car or wanted to catch the other car and was too late for it.

Then it must have been about 2:19 wasn’t it, according to your statement?

A

No, it was after that.

Well I know but he came in and said that he either had just got off from that car or that he wanted to catch that car and he had lost it, is that true?

A

Yes, sir.

Well now how far is the car situated, going by your place there?

A

He done a little business before he come in there, quite a little.

You can’t remember whether he said he wanted to catch that car or whether he said he had just got off from it?

A

No, I cannot.

Now I would like to have you tell me if you will - -  I don’t want to continue this examination very long, but I would like to have you tell me what particular thing there was about Bill Shimmel there that day that caused comment and caused those people to talk about him?

A

I don’t know as there would be any more than anybody else - - a stranger in town.

Was Bill Shimmel a stranger there?

A

Why he was a stranger and still he wasn’t a stranger, the boys could not place him who he was.

Who couldn’t place him?

A

The boys that was in there.

Who was the boys - - the boys that you refer to here?

A

Yes, sir.

And you say the traveling man made some remark about him?

A

I didn’t say that the traveling man made any remark about him.

Did you say anything about the traveling man saying anything?

A

No, sir, I did not.

What did those fellows say about him?

A

Why they were asking me who he was.

And what was he doing when they were asking who he was?

A

Why he was standing out there watching them play cards.

Was there anybody around him standing watching him?

A

Yes, sir, quite a few around him there.

A

A

There wasn’t anybody in there on the 22nd day of April.

A

Why all the boys around town about, all of them was in there.

A

The same old gang - - about all there is there that come in.

And who was there on the 24th?

A

About the same boys.

A

Why there is once in awhile strangers come in.

Did every one of the boys stand around and want to know about that fellow?

A

Some times they do and sometimes they didn’t.

And can you tell me one person that was in there on the 24th?

A

Jim Damerell was in there on the 24th.

A

Was anyone else in there?

A

I don’t know but he was too.

Was there anybody else talking with you about this case on the 24th?

A

I was talking with the boys around town.

Now do you know a man by the name of Griswold?

A

Frank Griswold, yes, sir.

Was he there on the 24th?

A

Why he was in there pretty near every day when he was around town.

A

I could not say that he was in there on the 24th, but he was in there on the 23rd with them boys.

A

Yes, sir.

How is it you recollect that now?

A

Why he was in the gang talking.

Now is there anybody else that you can remember that was in the gang?

A

A

I don’t recall any more now.

Was there a fellow by the name of Charley Duke or Duck, whatever his name is?

A

Charley Douck was there at night after the lights were lit.

What time at night?

A

I think it was about six or a little after.

Wasn’t he in there in the afternoon?

A

He was not.

You swear to that do you?

A

Yes sir.

Was he in there on the 24th also?

A

No, sir.

Isn’t he a frequent customer of yours?

A

Why he used to come in there most every time that he come down.

Why him and Fremont Brown come in together when they come in.

What time did they come in?

A

About three o’clock, somewheres along there.

And how long did they stay?

A

Why they were there somewheres about an hour, maybe not quite.

And which went away first, Shimmel or Fremont Brown and Douck?

A

Fremont and the rest of them went out first.

How long after that did Shimmel go?

A

Somewheres about a half an hour or a little after.

What time did the traveling man leave?

A

I couldn’t say exactly what time he left, he wasn’t in there only just a little while and went out.

Do you remember about what time all theses other people left?

A

Why they kept stringing along out during that time until nine o’clock, in and out.

And you can give the exact time can you, when Mr. Griswold came in there, about three o’clock?

A

Yes, sir, somewheres along about three o’clock when he came in there.

Who did you say this traveling man came in with?

A

Ed Brown.

Is he a brother of this other Brown that you speak of?

A

Yes, sir, he is.

Did they all come in together?

A

They did not.

Came in separately - - which came in first?

A

Fremont Brown and Griswold came in together and then after awhile the traveling man and Ed came in.
